The Why, Who, When, and How of the BC Speculation Tax

By now you’ve likely heard of the new BC speculation tax.  Whether you’ve followed the discussions on it in detail, or only heard about it in passing, the speculation tax is now a clear and present reality.  That said, it’s important you as a homeowner are aware of what it means.  How it affects you. This quick read will provide you with a brief outline of the speculation tax.  It will give you direction that you’ll want to take immediately.

The BC speculation tax was designed as a provincial measure aimed at tackling the housing crisis in BC’s major urban centers. Its purpose is to target both foreign and domestic speculators.  Those who own homes in BC, but don’t pay provincial taxes.  As well, the speculation tax seeks to turn empty homes into good housing opportunities.  Thus relieving both rental shortages and discriminatively high home prices.

Who?

The speculation tax applies to only those homeowners living within designated taxable regions in BC.  It’s believed that over 99% of British Columbians will be exempt from the tax. To be exempt, there are several facts you should know about how the speculation tax works, and about what you’ll need to do to ensure you’re handling it correctly.  

First and foremost, BC residents whose BC home qualifies as their primary residence (meaning they live there 6 months or more per year) will be considered exempt from the speculation tax.  Also, if you are a BC resident and you own property that is rented for at least 6 months out of a year, you may be considered exempt.

If you are a homeowner in BC, and you’re not a BC resident, then you will likely be subject to the speculation tax.  The rate at which you are taxed will differ according to your residential status and locale. Please consult with your accountant to determine your precise rate.  

When?

To qualify for exemption from the BC speculation tax, each person on title needs to individually file a disclosure through the accepted methods.  The disclosure must be filed no later than March 31, 2019.

Failure to disclose by March 31, 2019, will result in mandatory payment of 0.5% of assessed property value.  If there are two people on title, and only one person discloses, then the person who did not disclose will be expected to pay 0.5% of their half of the assessed property value.

Applicable BC homeowners will need to file for exemption from the speculation tax each year.  Each homeowner on the title will receive a notice by mail.  Then each individual must register either online at gov.bc.ca/spectax or by calling 1-833-554-2323

If you are required to pay the speculation tax, payment will be due July 2, 2019.

Any time a new tax is announced there’s a natural amount of confusion and perhaps some fear.  Knowing the facts, however, is key to keeping confusion minimal and fear at bay. Most important right now is that you’ve read this and are a little wiser as to how to proceed.  The BC speculation tax is upon us, so be sure to prepare yourself accordingly. If you’re a BC resident, and living within the taxable regions, then please do yourself a favor and file your disclosure for exemption immediately.  You won’t be sorry you did.

Where did you meet?

Tracey:  We met in Calgary in 1999.  We both worked in the retail industry at the time and the stores we were running were across from one another.

When did you move to the Okanagan?

Quincy:  We moved in 2009 when our oldest son Gabriel was almost 2, and Tracey was pregnant with our second son Paxton.  We were looking for a quieter city to raise our family that had a great sense of community, for that reason, we decided on Kelowna.

Tracey: I wanted to move back to Winnipeg where I am from and Quincy wanted to go back to the coast where he grew up.  Kelowna was a great compromise!

Tracey:  I like the work/life balance we have.  We are so lucky to be able to balance our time so that we can spend time watching our kids grow up.  They grow up too fast.

Quincy:  I love the lifestyle.  We ski and snowboard with the kids in the winter, and boat and bike in the summer.  Life doesn’t get any better than that.

What do you do when you’re not in the office?

Tracey:  We spend most of our time with the boys at home.  We are real homebodies. We do family movie nights on Fridays and spend most weekends up at Big White.  In the summer, we are out on our boat or in the pool.

Quincy:  Tracey and I like our TV.  We like to watch Netflix series and movies most nights.  When we can, we like to travel.

What is the best trip you’ve been on together?

Quincy:  It would be our trip to Europe.  We went for 3 weeks. I took Tracey to the Madonna concert in Amsterdam.  It was amazing. But more significantly, this was the trip we decided to start a family.  I will never forget that.

Tracey:  That’s a tough one.  We have traveled to some amazing places.  I would have to say our first trip to Tofino. Quincy took me there when we were dating and introduced me to the ocean.  Since then we have been back every year with our family.

Tracey:  I love his determination and resilience.  He is a strong, confident man and I admire that about him.  He deeply cares about the people in his life and would do anything for them.   And he makes me laugh!

Quincy:  I love her tenacity.  Not only is she a great business partner, she is a great mom to our 2 boys.  She is supportive, caring, and hardworking.  I don’t know what I would do without her.

Quincy:  I like to tell people that Tracey tried to break up with me when we first started dating.  

Tracey:  That’s true!  I took him out for lunch to have the “let’s just be friends talk”.  But he proceeded to tell me, “Take the weekend to think about it, you will realize it is the wrong decision.  We have a good thing going here and we should be together”. Now here we are, 20 years later. What a salesman!

What have you learned the most about being partners in life and business?

Tracey:  That communication is the key to success in any relationship.  

Quincy:  That Tracey is always right!

Upper Mission

This area was cleared out by the Okanagan fires of 2003 as a result, is now one of Kelowna’s fastest growing communities.  High in the hills of Kelowna, this Lakeview community features mainly newer homes with vast panoramic views of Lake Okanagan.  These lakeviews are primarily of Lake Okanagan and the growing community around it. Because of the south and west facing views, it  makes this Lakeview community popular for the sun seekers looking to soak in the Okanagan sun.  While some of the north facing views get a glimpse of downtown Kelowna.

Glenmore

The Lakeview community of Glenmore is nestled up against Knox Mountain.  A popular mountain for hiking, biking and sightseeing right in the heart of Kelowna’s downtown.  This small lakeview community has a mix of old and new homes. There are some of the best waterfront properties in Kelowna found in this area.  Most homes here offer big, west facing lakeviews from Peachland to Vernon.  

 

Dilworth

Established in the 90’s Dilworth is still building homes today.  Dilworth mountain is in the centre of Kelowna making lakeviews quite unique.  This lakeview community has some of the most diverse views of Lake Okanagan. Depending on the position of the home, these lakeviews can encompass both city and Lake Views.  A more lively night view with lights twinkling for miles.

Wilden

Wilden is a newer lakeview community located north of Glenmore.  This area has a more rustic feel with the lakeview through the towering evergreen trees.  This area is on the other side of Knox mountain and features newer, craftsman style homes.  

East of Kelowna

South East Kelowna

East of Kelowna, this lakeview community seems like it is miles from the city yet it is only minutes away.  Surrounded by acreages, orchards, vineyards and golf courses, the views are serene. Mainly larger homes in the area, and only few with these prime Lakeviews.  Therefore, the ones that do are picturesque. Lake Okanagan is framed by the lush rolling hills of South East acreages. Truly a spectacular setting to view the lake.

Ellison

Ellison is mainly a flatter residential area and farming community, also home to the Kelowna International Airport.  The views in this lakeview community are found in the homes perched above the flats of Ellison. These lakeviews are just a portion of the views captured in this area.  The lake is off the distance over the city of Kelowna, the vast orchards and large acreages in the area. An active night view as planes land of the tarmack of YLW.

There are mainly newer homes in this lakeview community.  The furthest distance from the lake, the west facing view is complex with a mix of city, mountains, orchards, golf courses and farms.  The higher up the mountain you go, the more vast the view gets, as a result, you get a little bit of everything from this lakeview community.
